description Historically, the ombudsman has been an autonomous state body whose purpose is the defense of human rights from the government, particularly from the Public Administration. Considering that this is its telos, it is -in general- a body of public law, generally elected by the legislature, to act as a supervisor of the public administration (although there are cases in which it even supervises other branches of government), with the purpose of defending the rights of citizens against possible abuses, omissions or negligence of the former. Since it is not a jurisdictional body, its resolutions lack binding force, hence it is defined as a magistracy of persuasion. Therefore, the strength of the ombudsman lies in his auctoritas, and therefore, his opinio iuris formulated through observations, reports and recommendations, have a transcendence not only legal but also in the fields of morals and public opinion. Hence, the ethical quality of its holder is socially indisputable. Considerado que ese es su telos, se trata -de manera general- de un organismo de derecho público, generalmente elegido por el poder legislativo, para fungir como un supervisor de la administración pública (aunque hay casos en los que llega a vigilar a otros poderes), con el objeto de defender los derechos de los ciudadanos frente a los posibles abusos, omisiones o negligencias de aquélla. Al no ser un órgano de carácter jurisdiccional, sus resoluciones carecen de fuerza vinculante, de ahí que se le defina como una magistratura de persuasión. Por tanto, la fuerza del ombudsman radica en su auctoritas, y por ello, sus opinio iuris formuladas mediante observaciones, informes y recomendaciones, tienen una trascendencia no sólo jurídica sino también en los ámbitos de la moral y de la opinión pública, de ahí que la calidad ética de su titular sea socialmente indiscutible. Considérant que cela soit son telos, il s’agit –de manière générale- d’un organisme de droit public, généralement élu par le pouvoir législatif pour exercer comme un superviseur de l’administration publique (quelquefois il y a des cas où il surveille d’autres pouvoirs) afin de défendre les droits des citoyens face aux possibles abus, omissions ou négligences de l’administration publique. Car il n’est pas un organisme de caractère juridictionnel, ses résolutions manquent de force contraignante, raison pour laquelle on le définit comme une magistrature de persuasion. Par conséquent, le pouvoir de l’ombudsman réside dans son auctoritas, et pour cela ses opinio iuris formulées à travers des observations, des rapports et des recommandations ont une portée pas seulement juridique mais aussi dans les domaines de la morale et de l’opinion publique, raison pour laquelle la qualité étique de son titulaire est socialement indéniable.
