La aparición de las Tecnologías de Información y Comunicación en los años noventa, motivó reformas al Código Penal Federal Mexicano para incluir la figura de delito informático; a la fecha no se ha actualizó dicha ley en esa materia, por lo que, no se puede sancionar a las personas por conductas no previstas en la legislación penal, quedando desfasado dicho delito.
