In the light of the 1958 Constitution and its successive reforms, is it possible for the President to go beyond what the constitutional text establishes, that is, to exercise meta-constitutional powers? In France the President has been characterized in recent decades by occupying an increasingly dominant position in the political landscape, this at the expense not only of the legislative branch, which has historically operated as a sort of officialdom of parties, but above all the Prime Minister, who is the other head of the executive. Therefore, based on documentary technique and following an analytical methodology, a critique of the transfer of the limits of presidential power in France is exposed.

El presente artículo de investigación examina, a partir del análisis político y jurídico constitucional, el ejercicio del poder presidencial en un sistema semi presidencialista como el francés. A la luz de la Constitución de 1958 y de sus sucesivas reformas, ¿es posible que el Presidente vaya más allá de lo que el texto constitucional establece, es decir, que ejerza poderes metaconstitucionales?. En Francia el Presidente se ha caracterizado en las últimas décadas por ocupar una posición cada vez dominante en el paisaje político, esto a expensas no solo del poder legislativo, que históricamente ha operado como una suerte de oficialía de partes, sino sobre todo del Primer Ministro, quien es la otra cabeza del ejecutivo. Por lo que, a partir de la técnica documental y siguiendo una metodología analítica se expone una crítica al traspaso de los límites del poder presidencial en Francia.
