210990“…La concepción de la familia y su protección en el ámbito jurídico actual, ha sido objeto de múltiples consideraciones y revalorizaciones en el contexto mundial, desde el enfoque y tutela progresista de los derechos humanos hasta las particulares y tradicionales visiones político-religiosas; no obstante, es un hecho que la familia se encuentra constitucionalmente protegida por la mayoría de los estados-nación, y que en algunos casos se incluye el reconocimiento de formas diversas de constitución familiar.En esta ocasión abordaremos lo relativo a la familia con un enfoque ius publicista para colocar las concepciones de familia a partir de un enfoque pluricultural, en el contexto del sistema romano-indígena.Para ello debemos afirmar en principio la existencia de un sistema jurídico familiar indígena, cuya existencia data desde antes de los procesos colonizadores, no obstante su reciente formalización constitucional en México.Reconocer que el derecho a los sistemas normativos de las comunidades y pueblos indígenas implica el reconocimiento a sus culturas, cosmovisiones y por ende el derecho a sus derechos, es afirmar la existencia de la pluralidad cultural y en consecuencia de la pluralidad jurídica.ABSTRACT: The conception of family and its protection in the current legal view has been the object of multiple considerations and revaluations in the world context, from the progressive approach and protection of human rights to the particular and traditional political-religious visions.However, it is a fact that the family has protection form the constitution in most nation-states, and in some cases, the recognition of different forms of family constitution is included.In this work, we will study what is related to the family with a ius publicist view, to place the conceptions of family from a multicultural approach, in the context of the Roman-indigenous system.We must affirm the existence of an indigenous family legal system, whose existence dates back to before the colonizing processes, despite its recent constitutional formalization in Mexico.Recognizing that the right to the uses and customs of indigenous communities and peoples implies the recognition of their cultures, worldviews and therefore the right to their rights, is to affirm the existence of cultural plurality and consequently of legal plurality.Keywords: Roman-indigenous system; Legal pluralism; Family.…”
